Providing an Introduction of Take Back the Night in Peel Region

Rebecca Pacheco, Coordinator, Peel Committee Against Women Abuse (PCAWA), provided an overview of PCAWA and its event Take Back the Night in Peel Region, to be held at 5:00 p.m. on Thursday, September 19, 2024 at the Malton Community Centre. The delegate emphasized the urgent need for more shelter space and beds for survivors of gender-based violence in Peel Region.

The Commissioner of Health Services advised that the Community Safety and Well-being Family and Intimate-partner Violence Action Table has brought over 38 agencies together to develop funding applications to the province.

Regarding Excessive Increases in Property Tax and Water Bill 

Regarding the Financial Impacts to Port Credit Legion Branch 82 Due to Wastewater Back Up (Related to 16.1 and 20.3)

Anne Lawrence, Branch Secretary, Royal Canadian Legion, Port Credit, Branch 82, provided an overview of Legion volunteer membership and operations; and a summary of the wastewater backup into Branch 82’s basement caused by a sanitary sewer pipe blockage located underneath the roadway of Front Street North. The delegate requested that Peel Region fully compensate the Port Credit Legion, Branch 82 to cover costs related to the incident.

The delegate answered questions of clarification regarding a letter from Peel to the Legion advising of a calcite build-up on municipal property, and the Legion’s reliance on volunteer staff.

Memo dated September 4, 2024, Regarding Compensation Request for Royal Canadian Legion, Branch 82 for Private Side Repairs and Improvements (Receipt recommended) (Related to 7.4 and 20.3)

The Commissioner of Public Works answered questions of clarification regarding the cause and location of the blockage; and provided an overview of Peel’s Sewer Back up Ex Gratia Payment Policy (the Policy) which provides that Peel may make ex-gratia payments in the form of grants up to a maximum of $1,500.00 in certain circumstances.

The Regional Solicitor and Commissioner of Legislative Services advised that under the Municipal Act, 2001, as amended, municipalities have no liability for situations where there are sewer back-ups or water escaping from pipes on either the private or municipal property, provided that the municipality has not been negligent. Peel’s Policy recognizes there is no liability in these situations, however, provides a gratuitous payment where there has been some damage caused to a private property based on a problem arising from the public side. It is expected that property owners would have insurance for damages, and the gratuitous payment of up to $1500.00 is intended to cover a portion of the insurance deductible.

NOTICE OF MOTION/MOTION

    Whereas the Royal Canadian Legion, Branch 82 (“Legion”), located at 35 Front Street, Mississauga had a sanitary sewer lateral blockage on July 7, 2024;

    And whereas, the Legion is a non-profit organization;

    And whereas, the Legion has incurred costs to identify and clear deficiencies within the wastewater lateral (“Maintenance Work”) due to having material deposits that were within both the private side and the Region’s side, a portion of which the Region offered to reimburse in the amount of $1,118.80 for rodding and CCTV but which offer was not accepted by the Legion;

    And whereas, pursuant to Resolution 93-255-40 Regional Council approved a financial cap for Policy F05-02 Sewer Back-Up Ex Gratia Payments which allows for payments up to a maximum of $1,500.00 for damages (“Damages”) resulting from non-storm related sanitary sewer backups that meet certain conditions in the policy; 

    And whereas, pursuant to Policy F05-02 the Region may make ex-gratia payments for damages resulting from a sanitary sewer backup provided all of the following conditions are met:

    1. That the blockage or defect in the sanitary sewer or lateral connection occurs on municipal property (including easements);
    2. That the backup is not caused by the negligence of the Region;
    3. That the backup is not caused by the property owner’s misuse of the sewer system or failure to maintain the sewer pipes on private property;
    4. That the backup is not caused by rainfall, flood or other natural occurrence unless a blockage in the sanitary sewer was a contributory factor;
    5. That an appropriate release is signed;

    Therefore be it resolved, that subject to the receipt of a signed release, the Region of Peel make a full and final grant payment to the Royal Canadian Legion, Branch 82, in the amount of $11,061.68 for all costs incurred by the Legion due to material deposits throughout the wastewater lateral on both the private and Region’s side, to be financed from Operational Reserves.

Councillor Dasko summarized the intent of the proposed motion to provide a grant to Branch 82 of the Royal Canadian Legion to compensate the Legion for all costs incurred due to the sewer back-up incident.

    That the report listed as Item 11.1 on the September 12, 2024 Regional Council agenda, be deferred to a future Regional Council meeting to allow the local area municipalities to report to their respective Council’s on the New Provincial Policy Statement – as it relates to new forecasting methodology and using the Ontario Ministry of Finance numbers.

The Chief Administrative Officer advised that staff had no concerns regarding a proposed deferral of Item 11.1.

11.2 Proposed Memorandum of Understanding with the Ministry of Municipal Affairs and Housing  

Councillor Brown summarized the intent of a motion regarding the proposed Memorandum of Understanding with the Ministry of Municipal Affairs and Housing. He advised that the motion was prepared by the three local municipal Planning Commissioners with consideration for the provincial direction that planning be done at the local level, and to address concerns regarding removal of duplication in the planning process and the current pace of planning applications at the local level.

Staff requested that the proposed motion be reviewed and dealt with later in the meeting.

Councillor Reid advised that all residents of Chartwell Heritage Glen Seniors Residence have safely transitioned to other sites, the building is officially vacant and renovations have started. He advised that some residents expressed concerns with the response.

Jeff Hennings, Director, Water and Wastewater Engineering Services, and Elvis Oliveira, Director, Water and Wastewater Infrastructure Planning, Partnerships and Compliance, answered questions of clarification regarding the relationship between stormwater and sanitary sewer water systems; how stormwater flooding can affect sanitary sewer water systems during a flood incident; and the benefits and potential risks associated with usage of a backwater valve.

NOTICE OF MOTION/MOTION

    Whereas the weather events on July 16, 2024 and August 17, 2024 delivered 106 mm and 170 mm of rain, respectively, in parts of the Region of Peel over a very short time period and resulted in thousands of flooded properties, and likely more than a billion dollars in property damage;

    And whereas, extreme weather events are anticipated to occur with greater frequency and intensity for the foreseeable future;

    And whereas, some property owners who are no longer able to obtain reasonably affordable - or any - flood-related property insurance due to previous claims or geographic location face significant financial hardship and risk in protecting or replacing their property as a result of extreme weather;

    And whereas, private property owners can be encouraged through financial incentives to install flood prevention infrastructure in their homes to mitigate the impacts of flood-related disasters;

    And whereas, a backwater valve attached to the sanitary sewer system can, in some situations, be an effective measure to mitigate the impacts of weather-related overland flooding;

    And whereas, the Region of Peel has established a Sanitary Backwater Valve Rebate Program valued at 100 per cent of the invoiced cost of installation, up to a maximum of $700;

    And whereas, the average cost of installation of a backwater valve by a professional plumber in the Greater Toronto Area is approximately $2,500;

    And whereas, the eligibility requirements of the current program include a) proof of a flooding incident and b) that a property has not previously received a rebate from a Peel Region basement flooding subsidy program;

    And whereas, the average life expectancy of a backwater valve is five to 10 years;

    Therefore, be it resolved:

    1. That the following be applied to the Region of Peel’s Sanitary Backwater Valve Rebate Program:
      • The value be changed to 60 per cent of the invoiced cost up to a maximum of $1,500;
      • Homeowners who have previously received a rebate from a Peel Region basement flooding subsidy program can be eligible for further rebates after 10 years; and
    2. That the changes noted above be put into effect retroactively to July 16, 2024 and all eligibility requirements, restrictions, terms and conditions be determined by the Chief Administrative Officer or his designate, in consultation with Legal Services; and
    3. That, in the unlikely scenario that the new rebate results in a higher expense to the applicant, the current calculation of 100 per cent of the invoiced cost to a maximum of $700 can be used for applications already in process and not beyond December 31, 2024; and
    4. That the total cost of reimbursements be forwarded to the provincial and federal governments with a request for compensation.

Councillor McFadden summarized the intent of the proposed motion regarding amendments to Peel’s Sanitary Backwater Valve Rebate Program. 

Councillor Parrish requested that the motion be amended to include that the total cost of reimbursements be sent to both the federal and provincial governments with a request for compensation.

Staff took direction to work with local staff, emergency response teams and conservation authorities to develop a communication toolkit for residents and businesses regarding sanitary sewer and stormwater drainage systems, and compensation programs available to protect private property from flood damage; and, that the toolkit include guidance to people who may have second units located in basements and to consider compensation for people renting basement units that are more vulnerable to the effects of flooding.

Staff took direction to offer flood waste pick-up and waive recycling centre fees automatically after flood events.

Staff were requested to provide Council with flood event neighbourhood mapping data.

19.1 Indwell Supportive Housing Building (Oral)

Councillor Butt advised of the official opening of Indwell’s new 40 unit supportive housing building in Streetsville, City of Mississauga, at 4:00 p.m. on September 12, 2024.

19.2 Peel Water Distribution Fee (Oral)

Councillor Horneck advised of concerns from residents with low water usage, regarding an increase of up to 100 per cent on their water bills due to the new distribution fee.

The Commissioner of Public Works undertook to report back to a future Council meeting to provide further clarity on the process that was taken to establish the new water rate structure, and the percentage of low water users and impacts on them due to the rate change.

19.3 Association of Municipalities of Ontario (AMO) Conference (Oral)

    And whereas, Chandra Vaidyanathan joined Peel Region in March 2013 and has been a dedicated member of the Health Services team for 11 years;

    And whereas, Chandra Vaidyanathan was a valued team member working within Health Strategic Planning and Partnerships as a Supervisor and Team Lead of Volunteer Services;

    And whereas, Chandra Vaidyanathan was very committed to her role and invested in growth and learning of volunteerism while providing meaningful opportunities for volunteers to contribute to Peel’s programs and services;

    And whereas, Chandra Vaidyanathan has touched the lives of countless numbers of volunteers and was known for her supportive nature and positive attitude;

    Therefore be it resolved, that sincere condolences be extended to the Vaidyanathan family on behalf of Regional Chair Iannicca, Members of Regional Council and staff of the Region of Peel.

    And whereas, Dusanka Sajdak joined Peel Region in September 21, 2004 and has been a dedicated employee for almost 20 years;

    And whereas, Dusanka Sajdak was a valued team member previously in Peel’s Long-Term Care facilities as a Nursing Attendant and most recently in Corporate Services, providing administrative support in Accounting Services;

    And whereas, Dusanka Sajdak was very committed in supporting our community’s long-term care residents and was known for her positive attitude and willingness to help others;

    Therefore be it resolved, that sincere condolences be extended to the Sajdak family on behalf of Regional Chair Iannicca, Members of Regional Council and staff of the Region of Peel.

ITEMS RELATED TO PLANNING AND GROWTH MANAGEMENT

    Whereas the Government of Ontario, under the leadership of Premier Doug Ford, has recognized the need for a more efficient and responsive local government structure that empowers municipalities to plan their communities effectively;

    And whereas, the proposed transition of land use planning services is intended to streamline processes, reduce bureaucratic overhead, and provide real efficiencies;

    And whereas, this transition aligns with Premier Ford’s commitment to ensuring that local municipalities are better equipped to address the unique needs of their communities, particularly in the delivery of more housing;

    And whereas, Bill 185, Cutting Red Tape to Build More Homes Act received Royal Assent on Thursday June 6th, 2024;

    And whereas, Bill 185 transfers upper tier land use planning responsibilities at the Region of Peel to the local municipalities of Mississauga, Brampton and Caledon;

    And whereas, the Peel Transition Board is expected to make further recommendations to the Ministry of Municipal Affairs and Housing on matters pertaining to service delivery of regional roads, waste, and water and wastewater.

    Therefore, be it resolved:

    1. That the Regional Official Plan is administered through the area municipalities until such time that the Regional Official Plan is repealed; and
    2. That until such time as a final decision by the Minister of Municipal Affairs and Housing is made on the future provision of water, wastewater, waste collection and roads, Region of Peel staff comments on development application are limited to water, wastewater, waste collection and roads, and such other responsibilities associated with specific mandates prescribed by legislation; and
    3. That until such time as a final decision by the Minister of Municipal Affairs and Housing is made on the future provision of water, wastewater, waste collection and roads Region of Peel staff be directed to confirm to Regional Council and local municipalities the timelines in which they will provide comments on development applications on service areas noted in paragraph 2;and
    4. That the local municipalities, who are responsible for growth forecasts for land use planning, be invited to establish a coordination group comprised principally of local staff and chaired by one of the municipalities to lead, confirm and maintain forecasts for long-range planning programs so that there is integration with the locals’ planned growth and infrastructure; and
    5. That the coordination group work with the Region of Peel and Province to amend the current draft Memorandum of Understanding (MOU) between the Region and the Ministry to remove any reference to the Region’s role in land use planning and associated growth forecasts and
    6. That the coordination group work with the Region of Peel and Province and develop an MOU that focuses on infrastructure delivery to respond to the need for municipalities to provide the Region with forecasts, timing and location of growth so that the Region would be positioned to then plan infrastructure and other Regional services in response to and advance local growth objectives in an equitable manner.

That the necessary by-law be enacted authorizing and directing that the following steps be taken with respect to the expropriation of the lands set out in Appendix I to the Closed Session report of the Regional Solicitor and Commissioner of Legislative Services, listed on the September 12, 2024 Regional Council agenda titled “Expropriation Proceedings – Steeles Avenue Widening – EXP-20041.00 – Chinguacousy Road to Mississauga Road – City of Brampton, Wards 4 and 6”:
        1. approval of the expropriation;
        2. execution and registration of a Certificate of Approval;
        3. registration of a Plan of Expropriation;
        4. service of the Notice of Expropriation, Notice of Possession and Notice of Election;
        5. preparation of an appraisal report of the market value of the expropriated lands and, if applicable, damages for injurious affection and other compensation;
        6. service upon the registered owners of the offer of full compensation and the offer for immediate payment of 100 per cent of the market value of the expropriated lands in accordance with s.25 of the Expropriations Act, together with the appraisal report;
        7. payment of compensation offered pursuant to s.25 of the Expropriations Act, upon acceptance by the owners;
        8. all necessary steps be taken to obtain possession of the lands; and
    2. That this recommendation become public upon adoption.
