AGENDA ITEMS SUBJECT TO DISCUSSION AND DEBATE

Regarding Active Transportation Coordination Within the Region of Peel

Referred to Public Works for a report to a future meeting

Pauline Thornham, Co-Chair, Brampton Cycling Advisory Committee, provided an overview of the Committee including its priorities for implementing Active Transportation Master Plan network projects and its goal to make better use of municipal resources through civic engagement. The Committee requested notification and consultation of upcoming Regional road projects so that Active Transportation plans in the Region of Peel and the three local municipalities could be coordinated and implemented for the benefit of all road users.

Members of Regional Council discussed and asked questions regarding: future opportunities for collaborative approaches between local municipalities; projects completed as a result of changes to transportation needs during the pandemic (e.g. temporary bike lanes); and, opportunities for active transportation within existing infrastructure.

The Interim Commissioner of Public Works undertook to report back to an appropriate committee meeting; and to include information regarding Regional staff participation on existing local municipal transportation committees.

Regarding the Critical Impacts to Farmers and Farm Families Related to the Letter from the Impact Assessment Agency of Canada Listed as Item 16.1 on the February 25, 2021 Regional Council Agenda (Related to 16.1 to 16.10 inclusive)

Tom Dolson, President, Peel Federation of Agriculture, provided an overview of the GTA West Transportation Corridor process including: a brief history of the project; reactivation of the Environmental Assessment in 2019; the recently confirmed preferred alignment of the project and preliminary design stage; and, critical impacts posed to farm families in the Region of Peel. He noted that the Peel Federation of Agriculture (PFA) is opposed to activists speaking to agricultural matters and opposed to the designation of a federal Environmental Assessment. He stated that the PFA is calling on all levels of government to make a final decision with respect the GTA West Transportation Corridor, expeditiously.

Members of Regional Council discussed and asked questions regarding: the impact of the Environmental Assessment process on the agricultural community; the impact of delays in decision making on farm assessments and succession planning; implications for succession planning as a result of an approximate 15 to 20 year freeze on lands; specialty crop farming versus conventional farming on Caledon farm lands; and, the process for selling land to other farmers.

    Whereas the Toronto and Region Conservation Authority (TRCA) Board of Directors’ (Board) Resolution A137/20, together with TRCA staff comments of August 21, 2020, comments on the proposed regulation for a streamlined environmental assessment process for the Ministry of Transportation’s (MTO) Greater Toronto Area West Transportation Corridor project (ERO #019-1882) and requested that the MTO commit to receiving TRCA Voluntary Project Review (VPR) sign-off , as well as enter into a service level agreement with TRCA for the provision of such services;

    And whereas, the TRCA VPR is a mechanism provided to federal and provincial Crown agencies that are exempt from TRCA’s Ontario Regulation 166/06 of Development, Interference with Wetlands and Alteration to Shorelines and Watercourses, and allows the agencies to voluntarily engage with TRCA through a formal process at the detailed design stage whereby TRCA staff complete a comprehensive review based on its expertise as a watershed management agency, and its interests related to natural hazards, natural heritage, including aquatic and terrestrial species and habitats, and water management and provide an opinion as to whether the interests, objectives and tests of the Regulation have been satisfied;

    And whereas, if TRCA staff can confirm that there will be no impacts to flooding, erosion, pollution, conservation of land or dynamic beaches, a VPR letter will be issued to the Crown agency or their agents confirming that TRCA regulatory interests have been met;

    And whereas, municipal governments and other senior levels of government and their agencies, including but not limited to Metrolinx, 407ETR, and projects on Parks Canada- Rouge National Urban Park lands, have received VPR sign-off in accordance with the review process, and further that a multi-year service level agreement is in place with Metrolinx for the provision of these services;

    And whereas, TRCA’s Board of Directors has endorsed the TRCA Guideline for Determining Ecosystem Compensation for approved infrastructure projects when impacts are unavoidable and as a last resort to ensure impacts are mitigated and/or compensated through an agreement between the proponent and the TRCA;

    And whereas, the Regional Municipality of Peel, Town of Caledon and City of Vaughan will be considering endorsing the TRCA Board request for the MTO to commit to receiving TRCA VPR signoff at the detailed design stage, to enter into a service level agreement with TRCA for the provision VPR review services, and use the TRCA Guideline for Determining Ecosystem Compensation where avoidance and mitigation is not possible, at future meetings of their respective Councils;  

    Therefore be it resolved, that the Regional Municipality of Peel endorses the TRCA Board request for the MTO to commit to receiving TRCA VPR signoff at the detailed design stage, to enter into a service level agreement with TRCA for the provision the VPR review services, and use the TRCA Guideline for Determining Ecosystem Compensation where avoidance and mitigation is not possible; 

    And further, that the Minister of Transportation, Minister Environment, Conservation and Parks, Toronto and Region Conservation Authority, Region of York, Town of Caledon and City of Vaughan, be so advised.

    Whereas Resolution 2012-923 indicates a level of support for the GTA-West Transportation Corridor;

    Whereas tens of thousands of jobs and billions in agriculture-related economic activity are at risk if the proposed construction of the GTA West Highway (413) is approved;

    And whereas, Ontario farming and food processing together employ one million persons and generate $35 billion annually, the Golden Horseshoe being the third largest agricultural producer in North America after California and Chicago;

    And whereas, the proposed Hwy 413 will slash a broad 52 km swath through agricultural, natural heritage and environmentally sensitive lands - bisecting 85 streams (10 of which are ecologically high priority) destroying seven entire wood lots including a 5.95 km length of forest, significantly fragmenting valley lands, disrupting 1,000 ha of land significant to wildlife movement - making serious incursions into areas protected under the Green Belt Plan;

    And whereas, the 413 project would create 8.8 million square metres of highway and transitway right of way including paved surfaces (880 hectares/2174 acres), the equivalent of 13.59 functioning Ontario farms without consideration of the co-located Northwest Greater Toronto Area Electricity Transmission Corridor (transmission corridor);

    And whereas, the 413 project will include a minimum of 60 metre right of way for an adjoining transitway, in addition to 110 metre highway right of way along with a co-located transmission corridor to support the sprawling employment buildings and residential subdivisions that will follow the highway;

    And whereas, a significant number of reputable organizations have demanded the cancellation of the project, including: Environmental Defence, the David Suzuki Foundation, the Federation of Urban Neighbourhoods, Gravelwatch, Halton Environmental Network, National Farmers’ Union- Ontario Rescue Lake Simcoe Coalition, Sustainable Vaughan, Transport Action Ontario, the Wilderness Committee and Sustainable Mississauga; as well as formal votes from the municipalities of Halton Hills and Orangeville;

    And whereas, the TRCA - which is the regulatory authority for developments in flood plains, wetlands and valley lands - has also objected to the potential impact of the proposed highway as well as the streamlined Environmental Assessment process - that process to which the Region of Peel has also objected;

    And whereas, Environmental Defence has filed a request for designation under Section 9 of the Federal Impact Assessment Act requesting the GTA West proposed project and associated Transmission Corridor to be considered within federal jurisdiction by way of it’s meeting the criteria for public concern, particularly since the Province is proposing a shortened EA process as well as the construction of bridges and other significant environmental disrupters in advance of the completion of the EA process;

    And whereas, the 3 year EA undertaken by the previous provincial government was shelved because of strong objection to the 413 by experts in the fields of rural development, renewable cities, agriculture, environment and efficient transportation who sounded alarms over predicted irreversible ecological harm caused by the uncontrolled, low density urban sprawl the 413 would cause;

    And whereas, the EA process was halted by the previous government and a three person expert panel was appointed that unanimously recommended the cancellation of the GTA West Highway 413, a recommendation that resulted in the project’s termination;

    And whereas, the Region of Peel is currently undertaking a Municipal Comprehensive Review process which will allocate residential and employment numbers to 2051 as well as areas of concentration for both, within the greenfield development designated for the Town of Caledon - a process which has already been affected by the proposed highway;

    And whereas, the current lack of opposition to the GTA West Highway by the Council of the Region of Peel has been cited as one of the provincial government’s key assets in pushing the highway forward;

    And whereas, the Region of Peel plays a significant political, financial and leadership role;

    Therefore be it resolved, that the Council of the Region of Peel approve the following:

    1. Strong opposition to any and all advanced construction associated with preparations for a GTA West highway and Transmission Corridor.
    1. Full support of the Environmental Defence request for a Federal Environmental Assessment pursuant to s.9(1) of the Impact Assessment Act (I.A.A.).
    1. Strong opposition in principle to construction of any transportation corridor traversing the Region of Peel, but specifically the currently proposed GTA West 413 highway and Transmission corridor which will wreak havoc on the environment, encourage residential sprawl and dependence on the car as a significant means of transportation.
    1. The motion be shared with Brampton, Caledon and Peel Councils, The Premier of Ontario, The Minister of Transportation, The Honourable Jonathan Wilkinson – Minister of Environment and Climate Change, Mississauga MPs and MPPs, Councils of the Regions through which the proposed GTA West Highway will travel.
    1. A response to the federal government request for comments be completed by March 3, 2021 and be sent to the Impact Assessment Agency of Canada.

Councillor Parrish placed a motion to oppose any and all advanced construction associated with preparations for a GTA West Highway and transmission corridor.

The Chief Administrative Officer (CAO) requested that Regional Council consider referring the motion to staff to bring back a fulsome report regarding the GTA West project history and planning impacts.

The Interim Chief Planner noted that the report could include information regarding the implications for goods movement, transit ways, the Municipal Comprehensive Review (MCR), planning processes currently underway, and planning for 2031 and beyond.

Members of Regional Council discussed and raised concerns regarding: Council’s role to set policy; public processes; clarification on the need for an Environmental Assessment if the highway is opposed; continued discussions with the provincial government regarding the transportation corridor; and, the March 3, 2021 due date to submit comments to the Impact Assessment Agency of Canada.

The CAO clarified that the comments requested by the Impact Assessment Agency of Canada are with respect to technical matters and process issues. She noted that staff could respond with comments by the March 3, 2021 deadline without compromising a future Council decision regarding the Highway. She confirmed that the proposed staff report could come back to the March 11, 2021 Regional Council meeting.

    That the Regional Chair write a letter to the Premier of Ontario on behalf of Regional Council to request that the provincial government reform its plan for prioritization of vaccine supply, eligibility and distribution to enable those areas of the province in prolonged shut down with high rates of transmission of COVID-19, including Peel, to accelerate the vaccination of their populations;

    And further, that copies of this resolution be sent to all Peel area MPPs for their awareness and active support.

    Whereas entry indices into the Grey zone remain murky;

    Therefore be it resolved, that if the case counts remain below 100 per 100k, and if public health indices warrant and hospital capacity remains favourable, Regional council recommends that Peel move into the Red Zone not Grey, understanding that Dr. Loh, Medical Officer of Health, makes the decision and recommendation to the province solely.

Dr. Loh, Medical Officer of Health, provided an update on COVID-19 reported case trends; variants of concern; extension of the Public Health stay-at-home order; and, the recent multi-dwelling cluster investigation in the City of Mississauga.

Dr. Loh and Brian Laundry, Director, Strategy, Policy and Performance, provided an update on Peel’s Community Mass Vaccination Plan including: the mass vaccination system capacity; vaccine prioritization; community engagement; targeted and ongoing communication and vaccine awareness building; and, Public Health measures to control the pandemic.

Dr. Loh stated that a dedicated Council COVID-19 Portal is expected to launch on Friday, March 5, 2021 and will include updates on key areas of the COVID-19 situation, the vaccine program, isolation housing and Public Health measures. An email alert will be sent to Regional Council when there is a portal update.

Members of Regional Council discussed and asked questions regarding: indictors required to move Peel out of lock-down and into the grey or red zone; actions needed to lift the provincial ban on outdoor amenities in Peel; the interconnection of Regions in different stages of lock-down; cross-regional travel for shopping; mobility trend tracking and access to the Provincial Health Agency’s broad mobility data set; the spread of virus variants; delays with the provincial on-line vaccination registration program; vaccination registrations through the Region’s partners (e.g. hospitals); communications to seniors; a request to expedite vaccine roll-out to areas that have been in prolonged shutdown and have the highest rates of transmission (provincial hot zones); federal delays in vaccine distribution; information for local doctor’s offices; and, how to request onsite mobile clinics for organizations involved with vulnerable populations.

In response to a request from Councillor Parrish, the Commissioner of Finance and Chief Financial Officer, undertook to provide copies of the letter to all departments referenced within it.

Councillor Groves declared a conflict of interest with respect to Item 21.1 listed on the February 25, 2021 Regional Council agenda. Councillor Groves participated in the discussion but refrained from voting (marked as absent) in accordance with the Municipal Conflict of Interest Act, as amended.

Janice Atwood-Petkovski, Principles Integrity, outlined how the complaint was investigated. She stated that there was sufficient information to confirm that Councillor Groves released in camera information and left other Councillors unable to correct an impression left publicly because to do so would disclose an in camera discussion. She stated that, in the view of the Integrity Commissioners, the disclosure was intentional and such a disclosure is undermining of the trust required by Council and the public.

Members of Regional Council discussed the report recommendations.

Some Members of Regional Council noted their disappointment with the way the complaint was managed and some of the report contents. They expressed their opinion that the recommended penalty was too high.

Some Members of Council expressed support for the process and the contents of the Integrity Commissioner’s report.

Councillor Saito placed a motion to provide direction to staff to support the request to designate the proposed GTA West Project under subsection 9(1) of the Impact Assessment Act, which would enable the project to be reviewed under the impact assessment process; and, to send the response to the Impact Assessment Agency of Canada by the deadline of March 3, 2021.

The Deputy Regional Clerk stated that the matter had been previously discussed, voted on and referred back to staff. A request to consider a new motion would require a two third majority vote to reconsider the matter. 

The CAO stated that the letter of response from staff to the Impact Assessment Agency of Canada, would be limited to the technical processes and could also refer to the resolutions passed by the Cities of Mississauga and Brampton and the Town of Caledon, which have supported a federal impact assessment.

Councillor Saito withdrew her motion.

    And further, that the Regional Solicitor be authorized to execute all necessary notices and any other ancillary agreements or other documents related to the Letter of Intent and Lease Agreement;

    And further, that the funds for and associated with the Letter of Intent and subsequent Lease Agreement be financed from Cost Centre PA00025 and Capital Budget 218324.
